1. Description of Service

SnapStatic is a web application that generates static HTML websites from Ghost CMS content. The service is available in a free tier with limited features and a paid Pro tier with additional capabilities such as higher page limits, search integration, minification, custom CDN support, and Git-based deployment.

2. Account Registration

To access Pro features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You agree to provide accurate and current information during registration.

You must notify us immediately at contact@snapstatic.io if you become aware of any unauthorized use of your account.

3. License and Permitted Use

SnapStatic grants you a limited, non-exclusive, non-transferable, revocable license to use the service to generate static versions of Ghost-powered websites that you own or are authorized to manage.

You are responsible for ensuring that your use of SnapStatic and the generated output complies with the terms of your Ghost installation, any third-party services you connect, and all applicable laws and regulations.

4. Restrictions

You may not:

• Resell, sublicense, redistribute, or white-label the SnapStatic application as a separate product without our written permission
• Reverse engineer, decompile, or disassemble any part of the service
• Use the service to generate content that violates applicable laws or infringes the rights of others
• Attempt to circumvent usage limits, security measures, or access controls
• Use automated means (bots, scrapers) to access the service beyond the intended API usage

You may use Pro features to build and deploy sites for your own projects or client work, but the SnapStatic application itself must not be redistributed or marketed as your own service.

5. Payments, Subscriptions, and Refunds

All Pro subscriptions are billed in advance on a monthly or yearly basis through our payment processor, Lemon Squeezy. Prices are displayed in USD and may be subject to applicable taxes depending on your location. Lemon Squeezy handles all payment processing, invoicing, and tax compliance as Merchant of Record.

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until your paid period expires.

As a goodwill policy, we offer a 7-day money-back guarantee for new purchases. If you are not satisfied, contact us within 7 days of your initial purchase and we will issue a full refund. This is in addition to your statutory rights described below.

6. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have a statutory 14-day right of withdrawal from the date of purchase, without giving any reason.

However, by subscribing to SnapStatic Pro and using the service, you expressly consent to the immediate provision of digital content and acknowledge that you lose your right of withdrawal once the service has been fully performed or you have begun using the digital content (in accordance with Article 16(m) of the EU Consumer Rights Directive 2011/83/EU and § 356 Abs. 5 BGB).

To exercise the right of withdrawal before using the service, send a clear statement to contact@snapstatic.io within 14 days of purchase. We will process your refund within 14 days of receiving your withdrawal notice.

7. Free Tier

The free tier is provided at no cost with limited functionality (restricted page count, limited daily generations). We reserve the right to modify free tier limits or discontinue the free tier at any time without prior notice.

8. Intellectual Property

SnapStatic and all associated software, design, and branding are the intellectual property of SnapStatic. You retain all rights to your own content and the websites you generate using the service.

We do not claim ownership of any content you provide to or generate through the service. You grant us only the limited right to process your content as necessary to provide the service.

9. Service Availability

We strive to maintain high availability of the service but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance.

10. Limitation of Liability

SnapStatic is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. We do not guarantee that generated sites will be error-free, uninterrupted, or compatible with every hosting setup.

To the maximum extent permitted by law, SnapStatic and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost data, lost profits, or business interruption, arising from your use of or inability to use the service.

Our total aggregate liability for any claims arising under these Terms shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless SnapStatic and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the service at any time if you violate these Terms. You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination, your right to use the service ceases immediately, and we may delete your account data in accordance with our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to the operator's jurisdiction. For consumers within the European Union, mandatory consumer protection provisions of your country of residence apply. All payment-related matters are governed by Lemon Squeezy's terms as Merchant of Record. Any disputes shall be subject to the jurisdiction of the competent courts.

14. Age Requirement

You must be at least 16 years of age to use SnapStatic. If you are under 18, you confirm that you have obtained parental or guardian consent to use the service and agree to these Terms.

15. User Content and Data Processing

To provide the service, you provide us with Ghost API credentials and content from your Ghost installation. You are solely responsible for ensuring that you have the right to use and distribute the content generated through SnapStatic, including any images, text, and media from your Ghost site.

We process your Ghost content only for the purpose of generating your static site. We do not permanently store your API keys or generated content beyond the duration necessary to complete the generation and deliver the output.

16. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will update the effective date at the top of this page and may communicate updates through the application or by email. Continued use of the service after changes constitutes acceptance of the updated Terms.
